Welcome to Crushh. Please read these Terms of Service ("Terms") carefully before using our application.

1. ACCEPTANCE OF TERMS

By accessing or using Crushh, you agree to be bound by these Terms. If you do not agree, do not use the app.

2. AGE REQUIREMENT

Crushh is strictly for users 18 years of age or older. By using the app, you confirm that you are at least 18 years old. We reserve the right to terminate accounts of users who do not meet this requirement.

3. DESCRIPTION OF SERVICE

Crushh is an AI companion application that provides:

• Text-based conversations with AI personas
• Voice messaging and AI voice responses
• Personalized interaction experiences

IMPORTANT: All personas and conversations in Crushh are generated by artificial intelligence. They are not real people. Responses are generated by AI and should be understood as entertainment, not professional advice.

4. ACCOUNT RESPONSIBILITIES

You are responsible for:

• Maintaining the confidentiality of your account
• All activities that occur under your account
• Providing accurate registration information
• Notifying us of any unauthorized access

5. ACCEPTABLE USE

You agree NOT to:

• Use the service for any illegal purpose
• Attempt to harm, harass, or exploit the AI or other users
• Upload malicious content or attempt to hack the service
• Use the service to generate harmful, abusive, or illegal content
• Share account credentials with others
• Circumvent any security features
• Use automated systems to access the service
• Misrepresent your identity or age

6. VIRTUAL CURRENCY (SHELLS)

• "Shells" are virtual currency used within Crushh
• Shells have no real-world monetary value
• Shells are non-transferable and non-refundable
• Shells may expire if your account is inactive for 12 months
• We reserve the right to modify Shell pricing and packages

7. SUBSCRIPTIONS AND PAYMENTS

• Premium features may require a subscription
• Subscriptions auto-renew unless canceled before the renewal date
• Cancel through your device's app store settings
• No refunds for partial subscription periods
• Prices may change with notice

8. AI-GENERATED CONTENT DISCLAIMER

• All AI responses are generated automatically
• AI personas are fictional characters
• AI may occasionally produce inaccurate or inappropriate responses
• Do not rely on AI for medical, legal, financial, or professional advice
• We are not responsible for actions taken based on AI responses
• AI does not have real emotions, memories, or consciousness

9. INTELLECTUAL PROPERTY

• Crushh, including its design, features, and content, is owned by Voice Companion Inc.
• You retain ownership of content you create
• By using the service, you grant us a license to process your content to provide the service
• You may not copy, modify, or distribute our intellectual property

10. PRIVACY

Your use of Crushh is also governed by our Privacy Policy. Please review it to understand our data practices.

11. DISCLAIMERS

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE:

• Uninterrupted or error-free service
• That AI responses will meet your expectations
• The accuracy of AI-generated content
• That the service will be available at all times

12. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Voice Companion Inc. SHALL NOT BE LIABLE FOR:

• Indirect, incidental, or consequential damages
• Loss of data, profits, or goodwill
• Emotional distress related to AI interactions
• Service interruptions or errors

Our total liability shall not exceed the amount you paid us in the past 12 months.

13. INDEMNIFICATION

You agree to indemnify and hold harmless Voice Companion Inc. from any claims arising from your use of the service or violation of these Terms.

14. TERMINATION

• You may delete your account at any time
• We may suspend or terminate your account for Terms violations
• Upon termination, your right to use the service ends immediately
• Sections regarding liability and intellectual property survive termination

15. MODIFICATIONS

We may modify these Terms at any time. Continued use after changes constitutes acceptance. Material changes will be communicated through the app.

16. GOVERNING LAW

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

17. DISPUTE RESOLUTION

Any disputes shall be resolved through binding arbitration, except where prohibited by law. You waive the right to participate in class actions.

18. SEVERABILITY

If any provision is found unenforceable, the remaining provisions remain in effect.

19. ENTIRE AGREEMENT

These Terms, along with our Privacy Policy, constitute the entire agreement between you and Voice Companion Inc..
